Export Administration Regulations & Implications for Malaysian Operations



Join AMCHAM on Thursday, 19 January 2023 from 10.30 AM - 12.00 PM for an IN-PERSON discussion and update on new U.S. export controls targeting China's advanced semiconductor and supercomputer capabilities with Nathan Bush of DLA Piper whowill share his insights and participate in a Q&A session.


On October 7, 2022, the Department of Commerce's Bureau of Industry and Security (BIS) released an interim final rule (Interim Final Rule) that implements several new export controls to restrict the People's Republic of China's (PRC) ability to obtain certain advanced computing, semiconductor and related manufacturing items from the United States and overseas sources that rely on US technology. The public comment period ended on 12 December 2022.


As with many U.S. export control measures, the ramifications of the new rules depend heavily on the precise classification of specific items (including goods, software, and technology) under the EAR. Although the scope of the new rules aims to focus precisely on a relatively "narrow" range of very advanced supercomputer and IC products and technology, the new requirements with respect to the global semiconductor industry are remarkably "deep" and far-reaching.


Operators of facilities in Malaysia would be particularly concerned because sweeping new changes to the Export Administration Regulations (EAR) apply both to US-origin items and items developed or produced outside the United States that are the "direct product" of US technology, software, plant, or manufacturing equipment.

    Nathan (Nate) Bush is a partner with DLA Piper, and he leads the firm’s International Trade and Competition & Antitrust practices in Asia. He was based in Beijing from 2004 through 2012, and has covered Asia from Singapore since 2013. He advises clients in internal investigations, government enforcement actions, and compliance involving antitrust and competition, international trade, and corruption and fraud. He has served as co-chair of Legal and IP Committee of AMCHAM Singapore (2017-present) and as Legal Committee Chairman (2008) and General Counsel (2009-2011) of AMCHAM China. He is a graduate of Harvard Law School and the University of Virginia. Nate has represented leading semiconductor companies, foundries, and semiconductor equipment manufacturers regarding export control, sanctions, and antitrust issues in Asia.
